This website is a community portal. It mainly serves to disseminate art and culture and to support book authors and artists. It is important to artdesign88 to provide a serious offer for reading enthusiasts and art lovers. Books generated entirely with AI are not allowed on this website, book covers and images are allowed.

Scope: The following General Terms and Conditions (GTC) of the artdesign88 community govern the legal relationship between artdesign88 and the users of the website. There is no entitlement to conclude a user contract.

Ownership and content of the website:
The Site contains materials, including, but not limited to, text, images, designs, photographs, videos, audio clips, graphics, button icons, images, advertising copy, URLs, technology, software, and the general arrangement or "look and feel" of such materials, including copyrighted material, as well as trademarks, logos, and service marks owned by either artdesign88, its licensors, licensees, or other third parties (collectively, the "Content"). artdesign88 is a community and the operator of the website and published on bookmamba.artdesign88.org (the "Website").
This Agreement governs your use of the Site and donations for artdesign88 products (the "Products"). The Site and Products are offered and distributed subject to your acceptance of these Terms and Conditions ("Terms" or "Agreement"). These Terms constitute a legally binding agreement between you and artdesign88. By agreeing to the Terms and Conditions, you also agree to these terms and conditions of artdesign88. You further agree to the Online Return Policy, the Store Return Policy, and the Shipping Policy, each of which is expressly incorporated herein by reference.

General rules of use:

You also agree to comply with all applicable local, state, and national laws and regulations regarding your use of the Website. You further warrant that you will provide true, accurate, current and complete information (and updates thereto) at all times when you submit information to artdesign88. You may use the Website only in accordance with this Agreement, and you may not use the Website or the Content for any commercial, political, obscene, illegal or inappropriate purpose.
artdesign88 reserves the right, at its sole discretion, to terminate your access to the website without giving any reason. When you register for an account on the Website, you may be required to provide an email address and password and there may be additional requirements which may be redefined by artdesign88 from time to time. You agree to assume all responsibility with respect to your use of the Site, including all activities that occur through your user account (and related content access). You must notify artdesign88 immediately if you suspect or become aware of any loss, theft or unauthorized use of your account/password.

User-generated content: Copyright:
The content and works on these pages created by the site operator are subject to copyright. By submitting or uploading any materials or content to the Site ("User Generated Content"), you grant artdesign88 a perpetual, irrevocable, royalty-free, worldwide, sublicensable and transferable license to copy, publish, translate, modify, reformat create derivative works from, distribute, reproduce and sublicense such materials or any portion thereof.
You hereby represent, warrant and undertake that the User Generated Content you provide will not violate any law or the rights of any third party, and you have the absolute right to grant artdesign88 the above license. artdesign88 is entitled to use user-generated content without incurring any confidentiality, attribution or remuneration obligations towards you.
The duplication, editing, distribution and any kind of exploitation outside the limits of copyright law require the written consent of artdesign88. If you become aware of a copyright infringement, please let us know. If we become aware of any infringements, we will remove such content immediately. The purchaser of any content from artdesign88 is entitled to copy the purchased goods for personal use, but not outside of their own living area. A resale of the goods with the intention of making a profit is not permitted. The reproduction rights are not transferable to third parties.

Events:
Portal members can publish their own events in the portal. Events must always be properly declared so that members can see the purpose. In the case of events for the purpose of sales, the organizer is responsible for all tax and legal points that are linked to them, according to his country. artdesign88 is never responsible for transactions and revenues from sales by portal members, let alone pay taxes. artdesign88 does not receive any commissions from events held by the portal members.

Fixed book prices:
Authors who maintain a membership account on the website are responsible for compliance with the statutory fixed book prices. If a book price deviates from a book offered at artdesign88, artdesign88 must be informed by the respective author of the corresponding book so that the price can be corrected.

Author pages, excerpts, book discussions, advertising:
Book discussions are not raffles and not competitions! Book authors can make their books available on the website, so that they can be read by interested parties/readers and then evaluated. To receive books, a user account as reader on the website is required. Author pages, advertising, excerpts and other content created by the author are the responsibility of the creator and never of artdesign88. artdesign88 only provides the infrastructure.
As the author, you are obliged to provide correct information on all pages you create via the website. You can publish prices in the items and content you create but dont sell over the website. Links to platforms or shops through which your items are sold are allowed. You can donate your books to artdesign88 or partners of artdesign88 and include the corresponding links to the articles in your pages. In such cases, the incoming go as a donation to artdesign88 and partners.

Business pages:
User of our Business subscriptions can create and publish their own pages on the website for advertising purposes. In addition, create your own products and link them to their pages and contents and is fully responsible for all of this. artdesign88 does not receive any commission and the website does not serve as a sales platform, but as a support for product visibility. On business pages, prices and further information about products may be given. However, the sale does not take place on our website. As a user of our Business subscriptions, you must make your business address visible on your pages. All tax law processes are your sole responsibility, never with artdesign88.
does not receive funds for product sales or participate in the settlement. You are required to provide accurate information on all pages and content you create. If you do not comply with the rules, you may be excluded from using the website with immediate effect. Amounts paid are non-refundable. If you become aware of a violation of the rules, you will receive a request for correction. They then have a maximum of three days to correct your mistakes. In order to give visitors the opportunity to react, business users and products can be evaluated.

Accounts:
Registration is free of charge. All fields marked as mandatory during registration must be filled in truthfully, correctly and completely. An e-mail address is required to create a user account. Book authors receive information on readers for the handling of their book discussions. This information/data may only be used in the context of book discussions or other options installed on the website and not outside of it. Every user (reader as well as authors) is obliged to store it responsibly. Personal data that is no longer required must be deleted. Example: The address for sending books.

Legal recourse is excluded! Books or other items are never bindingly promised via the website, they are not prizes. Book authors choose the readers themselves for their books. Readers are not chosen at random, as is the case with a raffle, for example. Book authors are responsible for the entire handling of their book discussions. artdesign88 only provides the infrastructure and exercises an advisory function at its own discretion. Book discussions do not serve as a sales platform, but are intended to make books and authors more visible.

Purchase of articles via the website:
All purchases made through the website are subject to the acceptance of artdesign88. This means that we may refuse to accept or cancel a transaction at our sole discretion and without liability to you or any third party. artdesign88 does not allow orders from dealers, wholesalers or customers who intend to resell the items offered on the website at a profit. Such an agreement requires written confirmation from us, which must be signed by us by hand.
Traders must indicate their business address on their pages in the portal, depending on where they sell their items and to which countries. artdesign88 is exclusively a supporter of visibility for book authors and artists and not a seller or sales agent!
artdesign88 expressly links the acceptance of your order to your acceptance of these Terms and Conditions and any additional terms and conditions made available to you on the Website. By ordering products through the Website, you agree to provide true, accurate, current and complete information. artdesign88 reserves the right to discontinue or change specifications and prices for products offered on and off the website without prior notice. Any offer on the website may be revoked by artdesign88 for the correction of errors, inaccuracies or omissions.

Limitation of Liability: Downloading or otherwise obtaining any content related to the services of the Website is at the User's own risk. He is solely responsible for any damage to his computer system or other technical equipment used for use or for loss of data or for any other damage resulting from downloading content or other transactions in connection with the use of the website and all subpages.

Donations and support:
Donations, be it an amount, a good in physical or digital form, will be transferred to artdesign88 in full to the extent of the donated amount or the donated number/copies of the good. This also applies to all rights of donated content (books, pictures, posters, etc.). The donor is not entitled to any remuneration. Donations cannot be canceled. They serve above all to preserve the community. Every donation can be transferred to partners and partner portals through artdesign88. Partners are entitled to use donated content in the same way as artdesign88 itself. 
- Before you can download content or we can deliver goods, you must make a donation for it, except for content declared as free. 
- Donations can be transferred/passed on from artdesign88 to partners. For example, for the preservation of the community.

Donations for the creation of content upon request and order by the customer:
- Made-to-order prints, maps, 3D models, or other digital content are not permitted for resale without our written consent. For resale, send us an inquiry!
- Any content created on behalf of the customer is to be paid with at least 50% of the agreed amount by advance payment and donation.
- Donations are non-refundable. In the event of a chargeback, the same amount as the refunded donation amount will be due as an expense allowance. The total amount must be transferred to artdesign88 as a donation within 30 days.

Returns of digital and printed items:
- For simple reasons, the return of our items is excluded. Books can be read, digital content can be copied. According to the customer, goods manufactured for the customer were created, for which artdesign88 put a lot of effort into processing and creation.
Items from our shop can be extensively examined before purchasing. Questions can be asked at any time prior to a purchase. Orders are manufactured with a lot of know-how and according to the wishes of the customers. In cases of restitution, costs incurred would harm artdesign88 to an unreasonable extent and could even make our further work impossible.

Website availability:
artdesign88 does not give any availability promise for a website that works 24 hours a day, 365 days a week. Warranties are excluded and Wortundgeistreich does not make any guarantee promise. Members are not entitled to permanent availability. artdesign88 cannot be held responsible for lost profits, solely because the website is not a sales platform.

Contract period:
The usage contract is concluded for an indefinite period of time. The User may terminate the User Agreement at any time by written termination. artdesign88 may terminate the user agreement without notice period. artdesign88 may close user accounts at its sole discretion in the event of violations of portal rules and guidelines.

Applicable law:
The laws of Uruguay shall apply to the exclusion of private international law. If the user is a consumer residing in the European Union, EU law does not apply.

Communication between members:
When communicating between members of the website, they are expected to observe mutual respect.
Not allowed:
- Commercial offers to other members of the platform
- Spam or intrusive behavior
- Disclosure to third parties of the personal information contained in the messages, unless there is verifiable consent.

Links to third party websites:
The Website may contain links to third-party websites, e.g. links from advertisers, sponsors, content partners, etc. The inclusion of any link on the website does not imply endorsement by us, and artdesign88 expressly disclaims any responsibility for the content, materials, accuracy of information or quality of products or services provided, available or advertised by such third-party websites. Severability:
We reserve the right to make changes to our website, policies, terms and conditions, including these Terms and Conditions, at any time. If any provision of these Terms of Use is invalid, void or for any reason unenforceable, such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. Should this happen, the provision shall be replaced by another legally permissible provision that corresponds to the spirit and purpose of the invalid provision. The exclusive place of jurisdiction for all disputes arising out of and/or in connection with these T&Cs is Montevideo.
